It’s time to decide on EBA 7
The ASU’s EBA 7 document has now been finalised and will shortly be circulated by Qantas ahead of a vote of staff. The new EBA 7 is a consolidation of the previous ASU EBAs 1-6 for Qantas and QFIT staff and is quite a long document. It also contains new EBA 7 provisions.

The Smith Family agreement goes to ballot
ASU members around the country have voted in favour of adopting the draft enterprise agreement negotiated with The Smith Family (TSF) management. This process is an informal process that the union uses to ensure that we know whether or not we can say that there has been an agreement reached between TSF and the union. The process is designed to ensure members’ democratic participation.

ASU National Operational Report 2004
The National Operating Report 2004 is a summary of the national activities of the ASU for the last 2 years. It is a requirement of the Australian Workplace Relations Act that unions are now required, in addition to their audited financial report, to produce for members a report that sets out the what the union has been doing on their behalf (broadly similar in concept to a Director's Report under the corporations legislation).

ASU National finances given a clean bill of health
ASU Financial Statements for 2003-2004. The Workplace Relations Act requires that the financial affairs of unions are checked and audited every 12 months to make sure union funds are administered properly and to detect any shortcomings. The National Executive and the Branches of the ASU each conduct their own audit.

Sunstate staff endorse some action
As Sunstate staff know we have reached a stalemate with the company over the negotiation of our current EBA. The company is refusing to give us a better deal despite the small cost of some of the changes we want to make. 2005 Minimum Wage Claim
The ACTU announced today it would seek a $26.60 a week wage rise for around 1.6 million award workers in the annual Minimum Wages Case. Applications have been lodged with the Australian Industrial Relations Commission which will hear the case in February next year with a decision likely in May 2005.

Qantas shareholders urged to oppose executive pay increases
The Australian Services Union will urge Qantas shareholders to vote against a proposal to increase directors’ fees by more than 66 per cent at the company’s Annual General Meeting in Brisbane tomorrow. ASU Assistant National Secretary Linda White said the pay increase for Qantas directors was excessive, particularly when compared with proposed pay increases of just 3 per cent per annum for Qantas workers.

ASU protects jobs and conditions in Tasmania
Over the last few months Tasmanian ASU delegates have been participating in an extensive restructuring of the Tasmanian Hydro Corporation. Agreement has been reached with management that there will be no forced redundancies and any redeployment will only be through negotiation. There will also be no salary losses or downgrades and a guarantee of ongoing consultation regarding the future of Hydro.

The ALP has released their child care policy with several critical differences between it and the Coalition’s views. ASU condemns attacks by Howard Government on state IR systems
This week the Howard Government has shown its colours on industrial relations (IR) once again. It has revealed its intentions to reduce employees’ rights to negotiate directly with their employers under state industrial relations systems (state awards). To the ASU this attack is targeted clearly at members in local government, the electricity and water industries and private sector clerical and administrative employees in Queensland, New South Wales, Tasmania, South Australia and West Australia.

ALP industrial relations policy a step in the right direction
The ALP’s industrial relations policy was launched in Sydney on Friday 6 August with ALP Shadow Minister for Workplace Relations, Craig Emerson, outlining Labor’s push for a national industrial relations (IR) system that would be built along the lines of the state systems in New South Wales and Queensland. The IR systems in those states were argued to provide a better return for both employees and employers.

Tasmanian SACS workers get 12% wage increase
The Tasmanian Industrial Commission yesterday endorsed the ASU work value claim for a 12% increase for specialist, professional and managerial employees under the Community Services Award. This was an important case that the ASU took on to remedy pay inequities in the Social and Community Services (SACS) sector.

An ASU teleconference with NCR delegates and organisers was held to discuss a national position on NCR’s ‘Yellow Card’ System. Participants were unanimous in their opposition to the system, and endorsed the petition that has been circulated around the country opposing the system.

Union Wins Wage Increases
The ASU has won the 2004 $19 national wage increase for employees covered by the Contract Call Centre Industry Award from the 1 September 2004. This decision also means an increase in allowances like Meal ($9.10) and First Aid ($10.90) which have also been increased to take account of the cost of living increases.

Members committed to a collective agreement at The Smith Family
ASU members at The Smith Family (TSF) took steps today to demonstrate their commitment to achieving a union collective agreement. Members in Queensland have written a letter to TSF management setting out their concerns and their commitment to the collective agreement. Meanwhile members in Victoria and NSW are wearing badges marked with the slogan "AWAs? No Way" to show their stance. Union delegates declared the day a great success with many members remarking on how good it feels to be carrying out even small actions in support of their claims.

Fuji Xerox EBA: no more negotiations
FXA management has advised the ASU that they intend to put a non-union EBA out to a vote without further negotiation. This is after the ASU requested that negotiations continue as soon as possible and after the unacceptable delay when management called a halt to the last negotiation meeting.

Australian Rail Track Corporation to negotiate EBA with the ASU
The ASU campaign to represent the employees at the super railway network company the Australian Rail Track Corporation (ARTC), moved on significantly with the ARTC now agreeing to negotiate a Enterprise Bargaining Agreement with the ASU. The EBA is to cover all direct employees of the ARTC. The agreement to negotiate the EBA came when ARTC management met with the ASU and other railway unions and the NSW Labor Council on July 23, 2004, in Sydney.

Peak community organisations in chorus against FTA
Although the ASU has been expressing its concerns for some time, in the closing stages of the campaign around the Australia-USA Free Trade Agreement (FTA), more community groups have been adding their voices to the chorus against it. On July 21, 2004, at a media conference in Sydney, these organisations called for the rejection of the FTA and signed a joint statement explaining the reasons for their position.

DOCS, analysts, trainers... why should they be in the Fuji Xerox EBA?
Since EBAs first started there have been new positions that have been created in the Service Department at Fuji Xerox. Some of this work was originally done by CSRs. Some is because technology has changed and because of a change to the business structure. In past many of the IT positions have been well paid. However, in the last two years there has been a dramatic turnaround in the conditions for IT workers. We believe that new positions do not have the same minimum conditions as CSRs. As it stands CSRs transferring to these positions lose some of the conditions they have fought for as technicians.

Changes to training structures for local government libraries, art galleries and museums
As expected, the CREATE ITAB (industry advisory training board) is being folded into the Innovation and Business Industry Skills Council (IBISC), which will mean that the training packages for local govt libraries, museums and art galleries will be in the hands of a new IBISC. This has occurred as a result of the Federal Government’s restructuring of the national training agenda, through the reduction of the number of ITABs to the new structure. Similar changes have occurred in the public sector, sport and recreation areas of local government.

Canon protected industrial action – success!
On Friday 3 June 2004 technicians employed by Canon Australia in Perth, Melbourne and Brisbane took part in national industrial action seeking fairer conditions of employment. It is believed that over 75 Technicians from Perth and Melbourne took part in a full-day stoppage on Friday. In addition a mid-day stop work meeting was held in Brisbane which was also well attended. An indefinite ban on all overtime has been notified around the country.

Canon technicians to decide on strike
ASU members who are technicians working for Canon from across Australia will hold meetings on Monday. This will decide whether to go on strike after negotiations for a new Enterprise Bargaining Agreement (EBA) have failed to resolve outstanding issues. This action is a last resort by employees. It follows months of negotiations and a last ditch attempt to conciliate an agreement in the Australian Industrial Relations Commission which also failed to reach agreement on Thursday 27 May 2004. An initial proposal by management for a non-union agreement has already been rejected by a majority of technicians in a vote.

Canon EBA: AIRC conciliation fails
Despite the efforts of your union representatives, attempts at conciliation in the Australian Industrial Relations Commission have not succeeded in reaching agreement. Family Day Care workers deserve a fair go says ASU

Support child care by demanding funding increases

$19 increase to minimum wage announced today
Today the Australian Industrial Relations Commission (AIRC) handed down a decision that granted a $19 per week increase in Federal award wages. This decision was in response to union applications seeking $26.60 and employers generally arguing against any increase above $10. The Federal Liberal Government supported the employers miserly $10 while State/Territory Labor Governments supported a $20 increase.

The ASU has finalised the Union’s Submission to the Senate Inquiry into the USA-Australia Free Trade Agreement (USA-AU-FTA). Due to the far reaching implications of the FTA, many ASU members in diverse industries could be adversely affected by its implementation in its current form. The ASU is committed to doing what we can to, at the very least, amend the FTA to protect our members. The Submission is part of this effort.

Canon technicians vote NO!
Management has now advised that a majority of technicians voted NO to the EBA agreement. Unfortunately, a decision was taken by management against the wishes of a number of state representatives to collect all the votes in Sydney and count them together – therefore we are unable to get a state-by-state break up of results.

ASU continues campaign to protect members from the GATS and FTA

National Women’s Conference resolves to campaign to make work life balance a national priority
The ASU National Women’s Conference was held on 24th and 25th March 2004 in Brisbane. Delegates from all Branches around the country attended the Conference. Canon industrial action: your rights
From Monday 29 March until Easter the ASU is organising industrial action in the form of a “Work to Rule” arrangement. Management and the Australian Industrial Relations Commission (AIRC) have both been advised of this by the ASU and as such it is Protected Industrial Action – that is, you have certain protection if you choose to participate in support of your claim for better conditions.

Non-union EBAs – are you on your own?
Canon has announced that it wants a “s170LK agreement”. This is an agreement directly with employees and is the same type of agreement that applies to the clerical staff and workshop technicians. Workshop technicians voted against this agreement last time but were outvoted by the office staff. Whereas management negotiates the current union EBA, it does not do the same with its non-union agreement. This fact sheet explains non-union EBAs.

ASU supports ACTU National Wage Case
ASU National Secretary Paul Slape has urged all ASU members to get behind the Australian Council of Trade Unions (ACTU) in its claim for a $26.60 per week pay increase for 1.6 million low paid award workers. "The claim is reasonable and deserves the support of all ASU members as it seeks to lift the minimum award rate of pay from $448.40 to $475 per week or $12.50 per hour which is necessary and economically sustainable," he said.

Canon EBA – below the midpoint
The Canon Consultative Committee held a telephone conference to consider the “package deal” presented in national briefing sessions. Even after a travelling road show where employee representatives were flown around the country to try to sell the agreement, the feedback has been that there is not enough in the package. Management can afford to fly managers and its selected employees around the countryside, but can’t find the extra money for a decent wage increase to restore the growing gap between Canon and the rest of the market in wages and conditions.

How does Canon’s EBA compare?
We have provided a table which summarises the key conditions in both the Canon and Xerox EBAs. The wages comparison is based on the minimum rates of comparable jobs in both agreements. Both companies must pay above these rates. A comparison of the minimum for Xerox is the minimum in 2001 (ie three years ago).

Canon’s dud deal
After three more frustrating days of meetings, it has become apparent that Canon has tried to employ the same tactics as last time in negotiating the agreement. It has now come up with a “settlement offer” which doesn’t have AWAs, but doesn’t deliver a good pay increase and doesn’t really address job security. Canon thinks this is a done deal – we disagree.

Qantas delegates meet again to discuss Jetstar
ASU delegates from Qantas at Hobart, Launceston and Coolangatta met with Jetstar representatives in Sydney on Friday, February 20, 2004 to discuss the announcement that Qantas is to be responsible for the check in in these ports. Canon EBA: no pay rise
Canon has released the new EBA covering a large part of what it sees as its “non-union” award covered workforce. This agreement does not include any real pay increase for employees who are currently above the minimum. There are no increases for two years unless management feels like giving one!

ALP-union relationship strong
The ALP National Conference meeting in Sydney last week confirmed the Labor Party-union partnership. The majority of ASU Branches are affiliated to the ALP and many ASU National Executive members attended the Conference and played an active role in moving amendments to the platform to improve it. ASU Assistant National Secretary Linda White was elected to the ALP National Executive which administers the Party in between meetings of National Conference (see separate story).

Tassie SACS work revalued
The ASU has won the battle to have the work value of SACS workers in Tasmania officially recognised. The Tasmanian Industrial Relations Commission has accepted the ASU’s claim that there has been an increase in the value of the work performed by SACS workers and that this increase should be reflected in the rates of pay for these workers. This represents a substantial move forward in improving the conditions for these workers and forms part of the ASU strategy to have the value of the work performed by our members recognised.

ALP supports self-determination in Western Sahara
The National Conference of the Australian Labor Party (ALP) held in Sydney 29-31 January endorsed an important policy on the issue of Western Sahara. The motion adopted unanimously "supports the right of the Saharawi people to self-determination and deplores the long delays which have so far prevented them from exercising their inalienable right to self-determination through a UN conducted referendum" the Conference "urges the UN and the international community to press Morocco to accept and implement the latest UN peace plan for self-determination of the people of Western Sahara without further delay".

Negotiations at United Airlines Kick Off

CTOs – Canon confirms suspicions
ASU representatives have now met with Canon in relation to the grievance lodged about Canon’s failure to consult about proposed changes to the way machines are installed. The meeting confirmed a number of things that we had suspected. This meeting highlights the need to include specific protection for job security in the current EBA. It is disappointing that it took the ASU lodging a grievance for Canon to come clean about its plans.

Rates and taxes – a fair share for responsible local government
The Federal Parliament’s Inquiry into “Cost Shifting in Local Government” has published its report entitled “Rates and Taxes – A Fair Share for Responsible Local Government”. The 210 page report covers the Inquiry Committee’s views and findings, and has provided a list of 18 recommendations to the Australian Parliament, for the information of state governments, local governments and community organisations. The Committee’s report acknowledges the significant contribution to the Australian community by local government, and thanks the councils and the unions, including the Australian Service Union, for their written contributions and attendance before the Committee’s hearings.

Canon says “NO”
After three frustrating days of negotiation meetings in Melbourne the company has chosen to simply say no to the ASU employee log of claims, rather than provide meaningful responses. What is worse, on items where the company had previously said it was in favour, it is now clear that these were meaningless words. The ASU and employee reps at the meeting were all disappointed by the approach of the company to the claims advanced by the ASU and employees.

Jetstar to employ check-in staff
Jetstar has today advised the ASU that it is their intention to directly employ customer service / check-in staff at Sydney, Melbourne and Brisbane airports to perform these functions for the new airline.

Qantas ETA Reclassification Refused
The dispute over the correct classification of the Qantas ETA position continues. As you would be aware, ETA staff and the ASU contends that the role of ETA has changed significantly since its inception, with the recent inclusion of handling complaint calls and misquotes – both functions previously handled by level 7 Supervisors.

Northern Territory Clerks get up to $100 safety net increase
The General Clerks (Northern Territory) Award 2000, which is the safety net award for around 10,000 private sector office workers in the Northern Territory, has now gained safety net rises of up to $100 a week and three additional higher grades in the Award. This is due to a win by the Australian Services Union before the Australian Industrial Relations Commission (AIRC) handed down on January 7, 2004.

Alice Springs Town Council employees win
Fifty indoor staff covered by the ASU (Australian Services Union) and around 60 outdoor staff covered by the LHMU (Liquor, Hospitality and Miscellaneous Workers Union) employed by the Alice Springs Town Council, have overwhelmingly supported a proposed new three year enterprise agreement. The Agreement will deliver a 10% pay rise, or no less than $63 a week extra, by Christmas 2005. An entitlement to 14 weeks paid maternity leave to eligible female employees is also part of the new Agreement.
