ASU wins decision against QTAC in good faith bargaining obligations

The Australian Services Union yesterday successfully applied to Fair Work Australia to have bargaining orders issued against Queensland Tertiary Admissions Centre Ltd.

Although the majority of employees at QTAC had appointed the ASU as their bargaining representative, QTAC had refused to meet with the ASU to negotiate a new Collective Agreement.

The matter was heard before Fair Work Australia Senior Deputy President Richards, who found that QTAC were in fact in breach of their good faith bargaining obligations as outlined required by the Fair Work Act, 2009 and granted bargaining orders to the ASU.

ASU Branch Secretary Julie Bignell said, "It is indeed disappointing that we had to take this step, however, we will not shy away from looking after the interests of our members."

Ms Bignell said that ASU members are pleased to see the new Fair Work Australia implementing this legislation in the new industrial relations era.

"This decision is not only a victory for QTAC employees, but also a victory for the wider community in seeing the Fair Work Australia laws working," she said.

QTAC must now meet with the ASU regarding collective bargaining for QTAC employees.
