Tasmanian
Senator shares
views on Fair Work
January 2010
Senator for Tasmania Catryna Bilyk, was
recently present during Fair Work Week in Tasmania which launched the full
commencement of Australia's new Fair Work system. As a former ASU Industrial
Officer and Trainer, we asked Catryna to share some of her thoughts with ASU
members in relation to the new industrial relations system.
I
was proud to be present at the signing of the Bi-lateral Government Agreement
for a National Workplace Relations System. Tasmania was one of the first
states to sign. This begins a new era of a more coherent and rational
industrial relations system across Australia.

It's
estimated that 30,000 employees and many thousands of Tasmanian businesses,
local government and community sector organisations will benefit from the
agreement, which puts them on the same footing in terms of industrial
relations and simplifies operations for all.
This
is wonderful for the ASU members who I used to represent and a historic
moment in restoring workers' rights following the horrendous years of
WorkChoices under the Howard Government.
The
new National Employment Standards (NES) that came into effect on 1 January
2010 represent a major change from the WorkChoices regime of the previous
Government. The NES form a new safety net with real protections and rights.

Finally,
ASU members need to be aware that the Federal Opposition is determined to
reintroduce WorkChoices-style individual contracts and the removal of unfair
dismissal protection for employees in small businesses should they be
elected. This would be a disaster for working Australians, putting their pay
and conditions at risk.

the 2009 Christmas edition of the ASU E News.
The
year 2009 has produced some interesting challenges to date, including new
Industrial legislation, major changes to the structure and operations of the
Federal and State Industrial Relations Systems with consequent impacts on
employees, and the transfer of many ASU members to new water bodies.
As
a Union we now look forward to the establishment of a National industrial
system to offer more equity for all employees.

Tasmanians want workplace
safety rights protected under new OHS laws
1 September 2009
Tasmanian
workers and their unions today launched “Don’t Risk 2nd Rate Safety Campaign”
as part of a national day of action in response to proposals to bring in one
set of new, standardised national workplace health and safety laws, called
‘OHS Harmonisation’.
Nearly
100 workers and their representatives gathered outside the Executive Building
in Hobart and delivered a letter to Minister for Workplace Relations, Lisa
Singh calling on her to stand up for the highest possible standards in new
Occupational Health and Safety laws when negotiating with her counterparts in
other states and with Federal Workplace Relations Minister, Julia Gillard.

After
a series of workplace meetings over the past couple of weeks, we have now
spoken to most members about the current progress of the EBA and received
some welcome feedback on the future direction that you want the ASU to
follow.
Currently,
the feedback seems to indicate that many people are very unhappy that Aurora
is conducting such a significant task as a complete salary and classification
review at such a late stage, and all Members who have expressed a view, have
indicated that they would not support a pay system that provided zero set
increases to allow for cost of living adjustments and salary maintenance in
real terms.
While
there were divided opinions at the meetings with many people wanting to
express their displeasure to the company immediately, other groups were more
circumspect, being prepared to wait for the information from Aurora’s consultant,
Mercer before deciding a future campaign direction.
At
this time members of one SBU Union have indicated they want to be able to
take protected industrial action in support of their claims and to persuade Aurora to negotiate for
an outcome rather than stalling, and they will be voting on this over the
next few weeks.
At
this stage the Australian Services Union has not lodged an application for a
ballot to take protected industrial action, but may do so in line with the
other SBU members APESMA and the AMWU who are about to do so.
I
would invite all members to think about how satisfied or otherwise you are
with the current negotiations and consider the options provided by filing for
protected Industrial action as a group.
If we are to file for protected action members will also need to
consider what they may be able to do in the way of action to support the
claims made at the negotiating table to improve your conditions and wages
outcomes.
This
can be everything from refusing to do call-backs or unpaid overtime, to work
stoppages. (filing for protected industrial action does not mean you are
going to take any course of action, only that you have that available as an
option.) At this point, with the other
unions either about to, or having already filed for protected action I would
suggest it is in our best interests to exercise this option.
If
you have been unable to attend one of the recent meetings, or you were at a
meeting and would like to comment further, please contact the ASU or one of
your ASU Delegates on the SBU (Paul Perry, Marilyn Turnbull)
At
this stage of negotiations it is essential that we are aware of the opinions
of all our members.
Please
talk about these issues with your workmates and if they are not members
encourage them to have a say by Joining the ASU and our campaign to get a
fair deal for all.

Eight
people have been honoured with Rainbow Awards for creating harmony in the
Tasmanian Community.
The
awards were presented at Bellerive’s Waterfront Hotel on Saturday 8th December 2007
in the lead up to International Human Rights Day on the 10th December 2007.
The
awards recognise and celebrate gay, lesbian, bisexual, transgender and
intersex people in Tasmania
and those who support them.
- Courage of
Conviction Award: Jo Goodman, for recognising the rights of the private
individual through her courageous and tenacious stand to have sexual and
gender diversity issues recognised at the local government level.
- Courage of
Conviction Award Recognising the Right of Private Individual: Australian
Services Union and Michael Swanton for recognising the rights of private
individuals in support provided to members of the gay and lesbian
community in their fight against discrimination, harassment and
dismissal in the workplace.

ASU acts quickly to protect
water and sewerage workers
April
2008
The
ASU is about to lodge a set of Claims in the form of a MODEL SET OF TRANSFER
CONDITIONS and CODE OF PRACTICE for those ASU members who will be affected by
the outcomes of the State Government Review into Water and Sewerage
provision.
The
Bulletin you can download below is issued for the information of current ASU
members and employees who may be affected.
The
Legislation initiated by the Government, is being debated in the Upper House
[Legislative Council] and the ASU will seek to brief the relevant
Parliamentarians about the position of the ASU on this most important matter.
The
action of the Government has been in haste and has caused the ASU to oppose
the contents of the draft legislation [which we only sighted in the middle of
last week] as it relates to the protection of employees in the transfer
process.
The
legislative protections proposed for employees do not go far enough and need
to be strengthened either in the Legislation or in a subsequent Framework
Agreement to be proposed by the ASU.
As
soon as the draft Agreement is finalised it will be forwarded to members to
be affected by this matter.

Tasmanian Treasury review into the provision of water and sewerage
services
ROLE OF THE ASU IN ANY CHANGE PROCESS
The
ASU is well known as the Water and Utilities Union across Australia.
The
work of the State Government in conducting a Review into Water [it’s
provision and treatment] is attracting significant public comment about the
various options available and potential impacts on water users and
ratepayers.
The
ASU will protect its members directly or indirectly involved in any process
of change by ensuring they suffer no disadvantage if change results in
employment transfer, Transmission of Employment or new employment with either
a public or private body.
You
can download a paper here which is provided for the information of ASU
members.
As
more information comes to hand, the ASU will forward it on to you.
If
you have any concerns, feel free to contact me. The ASU will meet with you or
any work group to discuss the current position.
The
ASU will also be conducting Regional Information Workshops over the next few

handed down State and Federal Wage Decisions for employees on State and
Federal Awards [without an EBA to fall back on] with different operative
dates and wage outcomes – See pages 3 and 5 of the e-News.

Tassie local government
workers transferred to Hobart
Water – but what about their conditions?

In early August the ASU held a meeting of
two groups of former Tasmanian local government employees with something in
common: both groups had been transferred by local councils and are now
employed by Hobart
Water. What has remained unclear is
whether they will retain the same pay and conditions they enjoyed when employed
in local government.
Both
groups are still doing the same or similar water/wastewater operational and
maintenance jobs that they were previously performing for the councils, but
now they perform those same jobs as employees of Hobart Water.
Former Derwent
Valley Council employees transferred
to Hobart water on 1 October 2006 and former Glamorgan Spring Bay
employees transferred on 2 July 2007.
This
transfer of workers to Hobart Water is the first pre-emptive response by
local government bodies to act upon the Tasmanian Government’s predicted
drive towards modernising water and wastewater services in Tasmanian local
government.
Other
local government bodies are expected to respond to the Government’s
initiatives over the next 12 months to two years. The full details of the
restructure are unknown at the present time.
The
ASU called the August meeting of operators and maintenance workers to discuss
how to protect their wages and conditions with an enterprise agreement at
Hobart Water.
Despite
promises by the councils which previously employed these employees “that they
would not be disadvantaged”, the legal protection only lasts for 12 months
under the Transmission of Business provisions of WorkChoices and Hobart Water
is not saying what conditions of employment will apply after 12 months.
The
current Enterprise Agreement at Hobart Water would disadvantage employees as
it does not provide a significant number of conditions which the employees
now get under the Municipal Employees Country Councils Award and respective
enterprise agreements, for example
§
plumbing allowance
§
sewerage allowance
§
extra week of
leave in addition to annual leave when regularly working on weekend
rosters
§
17.5% annual leave loading
§
grace days between Christmas and New Year’s Day
§
Easter Tuesday holiday
§
three weeks pay per year of service for
redundancy pay etc.
Negotiations
have been proceeding for over 12 months and negotiations are expected to
continue for some time yet.
The
ASU believes it is critical that the conditions of these workers are
protected now or this will be the thin end of the wedge for council based
water workers in Tasmania
who transfer out of local government. Our position remains that those workers
must not be disadvantaged by their move from their original employer.

Despite Federal
Government advertising campaigns extolling the “benefits” and “fairness” of
WorkChoices the ASU is regularly seeing instances of employees across many
workplaces being forced onto a system of “concession bargaining” a system
whereby workers feel compelled to give up hard won conditions in order to
retain as many of their pre-WorkChoices conditions as they can.
In the first 12
months of these new IR laws hundreds of thousands of workers on AWA
individual contracts lost their penalty rates, overtime pay, public holiday
rates, shift allowances, leave loading, meal breaks and other formerly
protected Award conditions.
Now more than ever,
is the time to be united, for united we stand, divided we beg.

Merger Announcement

The
Australian Services Union (ASU) said today that the notification to Credit
Union members yesterday by the Island State Credit Union and Connect
financial of the signing of a Heads of Agreement was the beginning of a time
of significant concern and major change for ASU members and for all
Credit Union staff in general.
The
ASU membership is in call centres’ and clerical, administrative and IT staff
at the Credit Union branches.
“It
would have been helpful to ASU members if management had advised the Union
and the employees of the discussions that had been taking place by the Boards
of Management prior to the negotiation of an Enterprise Agreement agreed to
in principle, just prior to Christmas,” Sean Kelly
, Secretary of the ASU said today.
Mr
Kelly also noted the serious concern that would be felt by employees with
Credit Union Board representatives publicly anticipating significant staff
losses, well before the possible merger is put to a vote of the shareholders
for approval.
The
ASU has indicated that it would immediately be seeking to speak with members to seek an indication of their
concerns and the questions they seek to put to management and the Board for
answers.

that the High Court has decided in favour of the Federal Government’s
WorkChoices legislation, the only way forward is to make your voice heard if

you know that we will enjoy a public holiday on Monday 13th March 2006 to
commemorate the introduction of the 8 Hour Day? In Tasmania,
over a hundred years ago, in 1874, Tasmania
became the last of the States to earn the shorter working day.

ASU National Energy
Division to meet In Hobart
in May
March 2006
The
ASU National Energy/Electricity Division Committee will meet in Hobart in May 2006 for two days to discuss current
issues affecting energy workers in Australia.
The
agenda for the meeting includes: conditions of employment; industry skills
shortages; a collective approach for electricity/energy workers at a company
level; reports from industry participants such as EE-OZ training; and the
National Electricity Ministers outcomes, along with the recent Council of
Australian Governments (COAG) announcements.

The
ASU Committee is made up of representatives of all ASU Branches with coverage
of energy/electricity workers:

pre-merger discussions of the ASU in 1992.

ensure their Branch representatives at the meeting in Hobart are informed of those concerns. All
