FedEx EA 2013 approved by Fair Work Commission but questions remain

The FedEx EA 2013 was recently approved by the Fair Work Commission but not before a challenge by the ASU in relation to inferior conditions when compared with the minimum safety net of the Clerks - Private Sector Award such as:

  • Part time - no written agreement on a regular pattern of hours nor certainty in overtime paid for less than 38 hours/week
  • No Job descriptors (just titles) setting out job responsibilities and competencies.
  • No Rest breaks – 10 minutes (x2) each half of the day.
  • Span of Hours - 5am to 7 pm rather than 7 am to 7 pm
  • No Allowances e.g. Job Search, Living away from home, District or Accident make-up pay.

Most importantly there are clerical and administrative classifications that are not covered by the agreement as follows:

  • Customer Service Rep
  • Senior Customer Service Rep
  • Senior Customs Rep

Are these employees just covered by the minimum award conditions or individual contracts or both?

The ASU decided not to hold up the agreement approval any further but has no reply from management after seeking further clarification on outstanding issues.

If you're an ASU member and you don't get:

  • Agreement cover
  • Rest breaks
  • Part-time overtime

then notify the ASU and we will test application of the agreement through the Grievance Procedure which could ultimately lead to a referral to the Fair Work Commission for resolution.
